Appeals Court Pauses Order Requiring Trump to Cease Deployment of National Guard

A federal appeals court has temporarily blocked a judge’s order that would have forced the Trump administration to hand control of California’s National Guard back to Governor Gavin Newsom.
The lower court had ruled earlier Thursday that Trump’s deployment of Guard troops to Los Angeles amid immigration protests was illegal. Judge Charles Breyer wrote, “His actions were illegal… He must therefore return control of the California National Guard to the Governor.” However, he delayed enforcement to allow time for an appeal, which was quickly filed.
The appeals court granted the Trump administration’s request, allowing the Guard to remain under federal control while legal proceedings continue. A hearing is set for Tuesday.
Trump invoked emergency powers, claiming a rebellion was underway in Los Angeles. California’s lawsuit disputes that, saying the protests, while intense, did not meet that legal standard.
Newsom criticized the deployment as a political stunt, writing, “The military belongs on the battlefield, not on our city streets.” The White House said the Guard was needed to protect ICE agents during raids.
The case now heads into a critical phase, with the appeals court set to determine the limits of presidential authority over state military forces.
